In any subsequent litigation or regulatory action, the key questions will be: 

  • Was the attack foreseeable? 

  • Did the organisation take all reasonable steps to prevent it? 

  • Can the organisation demonstrate a robust and modern security posture capable of defending against such advanced threats? 

Relying on outdated security measures could be interpreted as a failure to adapt to the known threat landscape, thereby weakening any legal defence. 

 

Mitigating Risk and Establishing Due Diligence 


In this new environment, legal and compliance strategies must be intrinsically linked to technological defences. The goal is to build a defensible position that demonstrates proactive risk management.
